Deputy arrested


According to Prosecuting Attorney Donna M. Price, Deputy Ben Wilfong has been arrested on five felony counts that include four counts of counterfeiting and one count of obtaining under false pretenses.

Wilfong posted $25,000 bond.

Corporal William Huddleston of the West Virginia State Police investigated the case.

Special prosecutor looking into allegations against sheriff's son

A special prosecutor is investigating claims that a Pocahontas County deputy who is also the son of the sheriff fired his department-issued pistol at his girlfriend's house.

Robert Alkire II, who is the son of Pocahontas County Sheriff Robert Alkire, was taken to the hospital after the Nov. 30 incident.

Robert Alkire II got into a verbal altercation with his girlfriend Jennifer Miller at her Marlinton home that spilled out into the street, said Special Prosecutor Dan Dotson, who is handling the case.

It was in the street that Alkire fired his department-issued weapon, Dotson said.

Dotson said Robert Alkire II was charged Jan. 25 with one count of wanton endangerment for the incident. Bail was set at $3,000.

"It was not fired at anybody in a malicious manner," Dotson said.

Alkire then went into Miller's house, Dotson said.

Police were called and Sheriff Robert Alkire arrived on the scene, he said.

Sheriff Alkire did not return a phone call Thursday regarding this story.

"The sheriff responded to the scene in Marlinton. At that point in time [Robert Alkire II] was in a medical situation," Dotson said. "The sheriff and a deputy came to transport him to a medical facility. They were unsuccessful."

The sheriff couldn't get his son to go to the hospital, Dotson said. Dotson declined to specify the "medical situation."

Emergency workers arrived on the scene and were able to transport Alkire to Pocahontas Memorial Hospital, Dotson said. Alkire II was placed on administrative leave immediately, he said.

Sheriff Alkire then talked to Marlinton Police Chief Everette Tinney and prosecutor Walt Weiford and told them what happened and that he couldn't be involved anymore, Dotson said.

"The sheriff placed him on administrative leave, then talked to the city police chief and he provided him with more specific information as to what occurred. And then he talked to the prosecutor and said, 'Hey, I can't have anything to do with this. Someone else needs to come in and look at it.'"

State Police were brought in to investigate, and Weiford requested a special prosecutor. Doston, a Braxton County assistant prosecutor, was assigned to the case.

Weiford said previously that he asked for a special prosecutor after learning that West Virginia State Police wanted to interview him about the incident.

State Police Trooper K.W. Huddleston was assigned to investigate, Dotson said.

"The police work has been excellent," Dotson said. "This was a top notch investigation. No stone was left unturned."

Sheriff Alkire was interviewed for about 90 minutes by Huddleston about his role in the incident, Dotson said.

"He did, of course, play a dual role. He handled it both as a father and a sheriff and he handled them both correctly," Dotson said. "If we thought there was any type of coverup, charges would be brought."

Robert Alkire II, "handled his department issue pistol in an unsafe manner and fired [it] in such a manner that it created a substantial risk of death or serious bodily injury to another," according to the criminal complaint filed in Pocahontas County Magistrate Court.

Other charges could be filed against Alkire II when the case is presented to a grand jury, Dotson said.

"We always start out with the bare necessities and if it has to go further in the process, we will look at other charges," he said.

If there is anyone who is jumping for joy, I say stop right there and think. Considering other issues that have been churned on these threads, this is certainly a milestone, a very serious milestone. I am more shocked than anything- before, during, and after.

We have all seen the checks and we know that the word "guilty", pronounced by anyone other than Wilfong or his counsel, is still way down the line.

The answers I am looking for are: 1) was this a product of pure arrogance or stupidity? 2) what other abberations are there involving Deputy Wilfong that were or are considered criminal and were overlooked? 3) what kind of mother goes around bragging about how her son allegedly commits a crime but will go scott free? 4) was Deputy Wilfong ONLY arrested because the evidence was so clear that a fraud was perpetrated?
5) does this lay any ground work for future arrests of Pocahontas' Finest determined under the Rule of Law standard of which the rest of us are subjected?

It is a sad day for everyone as well as a relief. The coming days will hold discoveries for everyone.

Now remember that the ball has shifted to the prosecutor's court now!

David Jonese took long enough to make the arrest (You will remember he still hasn't done anything about Totten and his buddy in the sexual assault that occurred on Jan. 20) We are not forgetting that!

But now the spotlight moves to Donna to move toward a conviction. I think that she is sincere in this (look at the counts that were handed down--that could put him away for a very long time)

We hope that David Jonese will use this arrest to encourage himself to move on the corruption that is rampant in this county. We have a serious problem from top to bottom.

So far the only blame with David J. that can be laid at his doorstep is hesitancy (delay) The Wilfong matter was so clear that it looked liked David was hesitating (and he in fact did hesitate) But as the cable guy would say, "Get'r done"

What we don't understand is why Wilfong himself waited so long to rectify the matter with Tim Wade (our source indicates that HE STILL HASN'T PAID HIS BILL) You would have thought that Wilfong would have sold one of those bulls and written Tim a check--better to have 99 cows and be free than 100 cows and in prison.

It appears that Wilfong thought he could get out of this!

(That's where the "arrogance" comes in) His mom apparently thought she could get him out of this but she couldn't and in fact made matters worse when it became public that she was trying to use family connections in the matter.

But you have to remember that the special prosecutor who was brought in here had to be bailed out of jail first. He was up on charges in a domestic related matter (sound familiar as in the Robbie case with his girl friend)

Special jury called for prosecutor beating

LEWISBURG — A Greenbrier County judge has ordered a special grand jury to convene next month to decide if a sheriff’s deputy will be indicted for allegedly beating county prosecutor Kevin Hanson last year during a front yard altercation.

Special prosecutor Dan Dotson of Braxton County filed a motion in circuit court last week and Judge James J. Rowe issued the order Friday for a special grand jury to convene March 18. The order also states that no member of the February grand jury, which meets today, may be called for the special grand jury.

Dotson said a special grand jury was necessary because the victim in the case, Hanson, presents evidence for indictments to the regular county grand jury.

Deputy Kevin Sawyers, a seven-year veteran of the Greenbrier County Sheriff’s department, has been charged by State Police with unlawful wounding stemming from an altercation with Hanson last August.

Dotson said up to 25 citizens may be called upon to comprise the 16-person jury. At least 12 jurors must vote that probable cause exists that a crime has been committed in order to “return a true bill” or indictment.

“The people that will hear the case must not have any ties to the recent grand jury,” Dotson said by phone Monday.

Names for grand jury lists come from DMV and tax records, as well as voting registration lists, Dotson said.

During a grand jury, prosecutors normally question the arresting officer and present evidence about the alleged crime. Rules of evidence are not followed and hearsay is allowed during a grand jury.

The accused may also testify in front of a grand jury, which is rare, but it must be done outside the presence of his or her lawyer. Judges give instructions to grand juries about the elements of a crime, but are not present during any questioning.

In September, a misdemeanor battery charge was upgraded to the felony charge of unlawful wounding against Sawyers.

Hanson, the county’s prosecutor since 2001, spent several days in a local hospital recovering from his injuries. He has not been charged in the incident.

Dotson said Hanson suffered a broken nose, separated shoulder, bruises, swelling, lacerations and abrasion from Sawyers’ attack.

The criminal complaint filed by Princeton State Trooper Sgt. M.R. Crowder states Sawyers, 37, “arrived at his estranged wife’s residence” on Aug. 2 and found Hanson “in the driveway area.”

Sawyers had previously filed for divorce from his wife, who is employed as a legal assistant at the county prosecutor’s office.

Sawyers’ defense attorney, Tom Czarnik, could not be reached for comment Monday. Sawyers remains free on $2,500 bond and was placed on paid administrative leave from his job pending the resolution of his charges.

If convicted, Sawyers faces a maximum prison sentence of five years.

sir wilfong may not know it but he is actually in a great position to cut one heck of a sweetheart deal right now.

if he, or his soon to be named attorney, were to kindly call the u.s. attorney's office or the federal bureau of investigation they could most likely strike a deal to drop or reduce the charges in exchange for witness testimony against all the payoffs, ripoffs and underhanded dealings of the sir daddy alkire empire, the sir weiford and sir tatano empire, and the local wvsp imperial stormtrooper empire.

think about it- all he has to do is learn to sing and he could have a new name, a new start, a new checking account, and a new job on a new farm somewhere in montana in the federal witness protection program!!!

Ben Wilfong was once a state policeman! The state police take care of their own! They are like the foxes guarding the hen house.

In all fairness to Rob, he was drunk and did some stupid, ridiculous things. Ben was just being malicious and arrogant. On top of that, Ben truly believes that he did no wrong because of his position with the county. Angie, Ben's mom, believed so deeply that Ben would walk out of this scott free. They will admit NO wrong doings.

On the other hand, Rob: Rob came onto Etater and faced the crowd. He faced a wrath like none other that I know and he admitted to screwing up. I wouldn't expect that with this case though.

so yeah we have all these cops that go around and bust people on drugs and so forth but have u really thought about it? really and honestly almost all the cops in pocahontas county are either drug addicts just like most of the town or want to sleep with young girls.i cant count how many i know that slept with some girls under the age of 18...its sad how they can bust you but they get away with it..and when it finally comes out nobody seen it coming...please all the cops are the same here..

we need to get the tv stations and newspapers from outside the county down here for the wilfong trial.

there needs to be a journalistic expose on the string of criminal calamities that occurs, concurs, and reoccurs with the corrupt cops of the loco poco forest. somehow, somewhere the payoffs, ripoffs, suckoffs and sweetheart backroom deals needs to end and be fully exposed.

You are right, Wilfong is not a bad kid, but even good kids commit crimes and need to pay the price of committing a crime. Police Officers are human and they do make mistakes, but they need to pay for them just like the rest of us, and if that includes jail time, then SO BE IT.

Also, the NERVE of Mr. Wilfong to turn around and Sue the Sheriff's Department claiming "Embarassment, Humiliation" ETC, ETC....how could they have embarassed and humiliated him any worse then he has to himself !!! He wasn't embarassed and humiliated until he wrote a fraudulent check ! WHAT NERVE !

The responses I am getting is amazement that (1) He would have tried to beat Wade out of such a small debt and (2) that he used a current check, never thinking that the bank did exist at the time of the "dates" of the check.

I thought about moving to the area when I retired as a police captain in North Carolina, but after reading the local paper for a couple of years I think I can do without the corruption. As for Ben Wilfong, all I can say is the man must be STUCK on STUPID.

Deputy charged with felonies - Wilfong files suit against former sheriff, commission

A deputy sheriff was arrested last Wednesday on five felony counts that included four counts of counterfeiting and one count of obtaining goods under false pretenses.

The criminal complaint, filed by Trooper K.W. Huddleston, of the West Virginia State Police, said that Deputy Benjamin M. Wilfong presented checks as evidence in a civil trial. The complaint said the checks were drawn on Pendleton Community Bank, but were dated in 2003 and 2004.

Pendleton County Bank changed its name to Pendleton Community Bank in 2005.

Further, the checks were written on the Mountain Top Angus account, which the complaint said did not exist at the bank until 2007.

Wilfong was the defendant in a civil trial, accused by Tim Wade, of Wade’s Farm and Feed, of not paying for goods he obtained at the agricultural store.

If convicted, Wilfong could face two-to-10 years in a state penetentiary on each counterfeiting count. Obtaining under false pretenses carries a penalty of one-to-10 years in the penetentiary or, at the discretion of the court, not more than one year imprisonment and a fine of $2500.

Wilfong has been suspended without pay from his duties in the sheriff’s department, Sheriff David Jonese said last week.

Wilfong has filed suit against former sheriff Robert Alkire, both in his official capacity and personally, and the Pocahontas County Commission, asking for compensatory damages for “severe emotional and mental distress, embarassment, humiliation, aggravation, annoyance and inconvenience.” He also asks for punitive damages, costs, pre- and post-judgment interest and reasonable attorney’s fees, as well as lost compensation.

In this civil matter, Wilfong alleges that he was injured in August, 2007, while he was on duty, was treated and filed a Workers’ Compensation claim.

On doctor’s orders, the complaint said, Wilfong was allowed to return to work later that month if he was provided a “desk job.”

Additionally, in September and October, he provided the sheriff with doctor’s notes that said he could return to work, but only to perform “light duty,” according to the complaint.

But Alkire refused to accomodate him and accused Wilfong of filing a false Workers’ Compensation claim, the complaint said.

In March, 2008, Wilfong was given his doctor’s permission to return to work without any restriction and later that month he was reinstated full-time, the complaint said.

But Wilfong alleges that Alkire and the commission refused to provide him with “certain pay increases to which he was entitled.”

Lewisburg attorney Brandon Johnson represents Wilfong.

Alkire and the commission will be represented by the Board of Risk Management.

The case has not been set for hearing.

Say, would it surprise anyone if I told you, that if it weren't for Wilfong ... I would never have had a traffic ticket in my 17 years of driving which resulted in my losing my license. To make a long story short, A friend or as he said "Buddy" of his, ran 5 children as well as myself off of the road.
Now , this "Buddy" of his was going so fast and driving down the wrong side of the road I followed him and he finally stopped and jumped out of his truck to confront me , hanging onto the rear mirror on the truck door to stand up he called me out and yes I am a Lady and the 5 children were with me still.
He was so obviously wasted and when he ran us off the road , he was in a curve where the speed limit is 25 mph, I guarantee he was going atleast triple that and if I hadn't been watching very carefully he would have rear-ended us.
Just by chance Wilfong passed me as he drove off (after our little confrontation) and I flagged him down. When I explained what just happened , He (Wilfong) said Oh yeah he's a buddy of mine just give me time to book the person I have now and I will call you in the next half hour. Well of course that call didn't come until 4 days later which gave the other guy plenty of time to sober up and from what I understand several people haved told me that he wasn't actually a sworn in policeman yet, which I really don't know why or what that means . But I do know that I got pulled over by Mr.Wilfong just days later for going he says 45 in a 40 mph zone, and when I told him I was on my way to the hospital with my son who was very ill with a temp of 106 I asked him if it wasn't a courtesy to give drivers 5 under or 5 mph over he smiled and said "only if we like you!"
Well the stress caused me to have a heartattack se veral days later and I was unable to fight the ticket and after being unconcious and on a ventilator for weeks I didn't remember the whole incident until a state trooper pulled me over for "THE ONE AND ONLY REASON WAS DRIVING ON A SUSPENDED LICENSE" now how did he even know this or to look for me, when I had NO idea myself? Pretty strange the way things work here in THE TWILIGHT ZONE...

Wilfong paid Wade. He ended up paying more because Tim went back over the books and found that Ben hadn't paid for quite a few things more!!!
