Recording a birth in 1861 - legitimacy

Hello,
I am hoping someone can help with this question about my GG grandmother. She appears on the 1939 register with her birthday as Feb 1860. She appears on the 1861 census as being 1 year old.
The GRO record also shows her birth as the first quarter in 1860. But the marriage of her parents did not happen until the 3rd quarter 1860. Therefore 'could' my GG legally be recorded as her father's name and not recorded in the mother's maiden name?

Sarah, the answer is yes. Marriage did not give legitimacy. That was given simply by the father agreeing on the birth registration that the child was his
