To Norman:

Did you notice in Item #5 of the Town Meeting Agenda how the "Amusement Tax" was included with the B & O taxes etc.. Makes it nice that the Town Council didn't approve it. Now Frank don't have to worry about the Railroad for awhile since he is their Bookkeeper. Hmmmmmmmmm!!! Make you wonder does it?

I would like to extend a thank you to Kinders Market for their families years of service to the community through their store. It means a lot to have good friendly service and someone who cares about the people. It is much appreciated.

It is interesting that the Amusement tax seemed to have the hearts of several people there. It did serve Proud's situation to not have that so he was more than willing to throw out the whole thing.

Putting a new tax on any person or business right now would not be a good thing unless the town desperately needed the money and it sounds like they are surviving like the rest of us.
I was told the town council didn't want to talk about raising taxes, but a citizen asked them to put it on the schedule and they had to bring it up.
The citizen who asked ---- John Osbourne ---- didn't even show up to pleed his case for new taxes. Wasn't he the one who wanted to be mayor but didn't pay his filing fee?

From what I have read, the rule on taxes changed in 2005 and a municipality can only tax under certain conditions. WV Codes chapter 8.

§8-13-6. Amusement tax.
Every municipality shall have plenary power and authority to levy and collect an admission or amusement tax upon any public amusement or entertainment conducted within the corporate limits thereof for private profit or gain. The tax shall be levied upon the purchaser and added to and collected by the seller with the price of admission, or other charge for the amusement or entertainment. The tax shall not exceed two percent of the admission price or charge, but a tax of one cent may be levied and collected in any case.

Any ordinance imposing such tax shall contain reasonable rules and regulations governing the collection thereof by the seller and the method of his payment and accounting therefor to the municipality



If Proud really cared about the Town of Durbin, the amusement tax would have been implemented. The town needs and can use the income.

The tax would in no way effect the train ride profits. Why, because the tax is added to the price of the ticket. One or two percent tax, is not going to keep anyone who is interested in riding the from purchasing a ticket.

Example:

Ticket price $20.00 x .02 = $.04 or a total cost of $20.04 for the train ride. No one will complain about the 4 cents.

Now lets multiply the 4 cent by 10,000 tickets sold. How much tax will the town receive? Four thousand dollars ($4000.00).

Now the above is an example, I do not know the price of a ticket nor do I know how many tickets are sold each year. You should get the point though, that the town would receive sufficient income from this tax.

Multiply that by 10,000 tickets would be $4,000.00

So the tax thing is worked out. Now what about that ordinance that no one wanted to here. It is obvious from the video that the council and the public didn't know it, nor did they care. I couldn't here what he was reading because of the people shouting things. Why in the world would the people not want an ordinance read aloud? Does anyone know what the ordinance was?

It seems the answer to everthing is stimulus money.
There are many intelligent people in Durbin and from Durbin. Find a native son(or daughter ) that knows how to apply for and write grants, probably as a community service or home town pride.

Just relax people. Everything is the same as it has been for the last few decades. Durbin will be OK.
This has been going on for years, just new players.
The town will always be there. Just look at how well the people are eating that live there.

103.3 In accordance with the prescribed procedures of this jurisdiction and with the concurrence of the appointing
authority, shall have the authority to appoint a deputy code official, other related technical officers, inspectors and other employees.

All Meetings that have to be posted are open to the PUBLIC. You do not have to be a resident of Durbin to attend or to speck.

I watched one of the videos and I have a question.
Is it proper/ethical or legal for the Mayor to suggest a motion be made? Is the Mayor allowed to make a motion? Especially a motion that deals with taxing his employer.

I may be wrong, but I don't think so. Maybe someone knows more about this.

She may not have been in order but she was just stating things that should have been listened to. She was near the A** as John Osborne jumping up in councils face and calling everyone ignorant. He should have spent some time in the regional jail with his girlfriend. The he ranted and raved when he wasn't selected to be mayor and when he didn't pay his filing fee. Then you have Don Jennings jumping up calling the council liars, kicking over the trash can and being escorted out by an officer. Now why didn't you mention how these fine upstanding citizen made A**es of themselves.

Getting it straight : It is legal for the Mayor to make a motion. I believe that you are asking if it was ethical due to conflict of interest. My opinion is that he should have obstained from motion or vote because he does have a conflict of interest in the amusement part. But it makes no differenes because the council all voted against it.

To: Getting educated. A BIG AMEN. How people forget so easily, when they choose to try an make someone else look bad, only to cover there own evil endeavors.
Just a Note of interest: The meeting was over when she ask the council person to read the ordinance, and the Mayor ask if anyone had anything else to discuss. So she did not disrupt the meeting at all.

What are the "evil endeavors" of some one who declares that the interloper was disruptive ? I got the impression that she was first on the list with her waving of the state laws.If the meeting was over, as stated, why was she even shown?What is her interest in this conflict?Is she a sewer customer, an employee, what? I imagine a council member would have some knowledge of state law.Perhaps she was indulging in histionics. Otherwise, she would have sent the council person a memo or spoke to him privately to educate him.

I don't mean to be picky, but I watched the video again, and I don't remember any time frame in the motion for 'not raising taxes'. Is this an eternal motion? Can Durbin never increase or create a tax ever again? Since when do you need a motion to do nothing?
I still think there is a fox in the hen house here. The Mayor is aware that condemned buildings DO NOT have to pay the utilities. Did he cut an inside deal with the people who the Town just took to court? Are they going to get out of the Town bills after all?
I have always been an advocate for the Town, but this meeting seemed very strange to me. Maybe this is why all of the people that I told to go to the meetings didn't go.

Evil-endeavors: When one tries to portray a certain person as the only one with disruptive behavior, but fails to include others that portray the same behavior. Lets plant some Squash!!!

Interlopers: Who are you to tell people they are not welcome at a Public meeting. PUBLIC MEETINGS are OPEN TO THE PUBLIC, not just town residents. Hale Hitler!!! You must own the Town. This is not a good representation for the Town. Does the town council uphold this behavior?
By the way I read the Pocahontas Times, Durbin article. If you notice there is nothing in the article about an ordinance, so it was not mention at all during the meeting. Need more Squash

As for what the Town is going to do about condemned properties, Several want to know that question!!! Maybe Thyme will work.
