Mystery Cop To be Revealed in 14 days

The sheriff's office and the prosecutor's office are asking for a little more time to resolve this matter of the groping complaint.

I talked with the sheriff today and he will not disclose who this co-cop was with Totten that night. I seriously doubt that David J. actually knew that there was another cop on duty. (Of course, "on duty" is the operative term. We hope that he will adopt a policy that all "officers" on patrol or undercover have to report in and be accounted for.

This is the second report that we have had that involved an unknown cop. The other was a report about someone with "lights" on their vehicle offering young girls money in Marlinton.

I talked with Darla this evening and she has agreed to give them two more weeks to resolve her complaint. I think that she is being mighty generous in that this occurred on Jan 21, 2009. And considering that she is a nervous wreck worrying about if and when she gets stopped again. It does not appear that Totten is going to be suspended in light of her complaint. Perhaps he will be a little more careful about the people he stops particularly the females.

The police have cameras in their cruisers so it is likely that there is videotape of this arrest. We will be asking for a copy of that videotape if there is no resolution of this matter soon.

There is substantial doubt that the camera was being utilized unless it has an automatic turn on. But the question of who is telling the truth here can easily be determined by production of the video tape. Likewise, we should be able to hear the conversation as well which will indicate if the officer was alone or had accompaniment namely females.

It has been suggested that the girls were informants. This may be true but it would put the officer in a most compromising position to have girls with him down a lonely road at Stillwell Park.

We are hereby making an offer to publish the arrest video on this website. That way we can see just what really happened down there in Stillwell Park.

If the arrest was legit, we would see no reason why the videotape should be withheld. It would prove the story one way or the other.

It is a little disturbing that the videotape has not been offered up for publication if it was actually made. We shall see!

Of course, Darla can subpoena the tape when this gets to court on April 1. We will ask them to allow us to copy it if they will be so kind as to request the tape from the sheriff's department.

just because a deputy has a camera is his vehicle doesnt mean there is sound. i dont think all officers with cameras wear mics.

Brad will make sure that tape never gets heard by anyone...I WILL BET YOU MY LIFE ON IT. I'd also bet that he will get away with this....Does Mrs. CJ Totten remember when this was her on the back road while Renee Totten waited at home for her husband ?

Many patrol car installed cameras only operate if the lights and/or siren are on, and/or the officer switched the camera on intentionally when the lights and/or siren were not on. Perhaps there is no video or audio.

If you're pulled over by any Police officer, you have the right to refuse to "step out of the vehicle" and request a Supervisor to come to the traffic stop. Crack your window and hand the police officer your license, registration and proof of insurance.
Sit in your car with the doors locked until the Supervisor arrives. The cop may be annoyed, but it is your right to have another officer come to the scene. It's better to be safe than sorry, especially if you're a woman who is traveling alone.
We're all taught to obey the commands of law enforcement officers -- and when a police-looking car is trying to get us to pull over, every instinct tells us to comply.
Still, it's important to use your head.
First, have you done something to deserve being pulled over? If you've been driving within 5-mph of the posted speed limit and haven't broken any traffic laws that you're aware of, your guard should be up if all of a sudden there's an unmarked car on your tail with its lights flashing -- especially if it's out in the middle of nowhere and late at night. While radar traps are a reality, most of the time, we get pulled over for a reason -- and we know perfectly well what it is. So if you honestly haven't done anything wrong that you're aware of -- and the "officer" just appeared out of nowhere -- you're right to be suspicious -- particularly if you are female and traveling alone.
Second, if the vehicle attempting to pull you over is not a clearly marked police cruiser -- or a car or truck that isn't routinely used for police work (especially if it's an older/broken down-looking vehicle) and your "creep radar" is telling you something's just not right -- you should slow down (to indicate you are not trying to get away, in case it is a real police officer), signal your intent to pull over -- but only do so when you can find a well-lit, public place with other people around, such as a shopping center parking lot.
Or, you can pull over immediately -- but keep your doors locked and only crack the window enough to pass your driver's license and registration through.
Third, get a good look at the "officer" and his credentials. If the "officer" is not in uniform, refuses to show you his badge -- or just flashes it briefly, so you can't get a good look -- keep that window rolled up and those doors locked tightly.
Ask once more to see his credentials. If he won't let you, tell the "officer" that you'd like for him to call another officer to the scene. This is your right -- and while it may aggravate the officer if he is in fact the real deal, it could save your life if he's not. A real officer will understand your concern and have no problem with calling a fellow officer (or supervisor) to the scene. There have been several case of women being abducted and raped by thugs impersonating police -- and most departments are very sensitive to people's legitimate concerns on this score.
Fourth, if the "officer" starts acting oddly when you ask to see his ID -- threatening you, behaving in a non-professional manner, pounding on your door, etc. -- seriously consider putting the car in gear and getting out of there. Tell the "officer" you are uncomfortable and that you will gladly follow him (or be escorted to) to the nearest police station.
If you have a cell phone, immediately dial 911 -- and tell the operator that you have been pulled over by someone who claims to be a police officer but that you think he might not be a real cop. Tell the operator exactly where you are -- and stay on the line. If it's a real officer, you'll know very soon. If it's not, the guy will almost certainly take off at this point. (Caution: Only take this step in a situation that clearly doesn't feel right as you risk an "attempt to elude" charge if it is, indeed, a real police officer. But again, better safe than sorry given the stakes.)

These precautions -- and some common sense -- should keep you from getting anything worse than another traffic ticket

I don't recommend stopping ANYWHERE unless it's well lit and other people are around, and if the "cop" starts threatening you (other than with arrest), or starts doing anything threatening - beating on the door or window, etc, - don't consider - get OUT OF THERE!! AND DO CALL 911!! It could mean your LIFE - don't take any chances!!!

Also, I don't recommend traveling alone - it's too dangerous!

It has been a week and Darla still doesn't know who groped her! Totten knows but he ain't talking. One more week to go!!!!

Was this an attempt to get you off of his back? Was the mystery cop ever revealed? Was Darla ever allowed to confront the person who groped her and was she even allowed to KNOW HIS NAME?

It was all covered up Lester and Darlia are paying fines and nothing has happened or do we look for it to in this county you get what you got and they are all togather in it ALL.
If the people that have incountered the first hand correption could be as good at getting rid of the TRASH in the courthouse as the courthouse is at keeping it togather we may have a chance,but who would listen to hard working honest people like us?
No one who cares or the correption would end.

Don't pretend like you do not get on here and see what is being written about you and those under you. Everyone gets on here and reads this stuff even if they don't respond. Why? Because it is a popular site and it is well known that this site had so much, if not everything, to do with why several people didn't make it into office and why some others did. Including you Mr. Jonese.

Now. I want to know WHY this lady Darla has NOT BEEN GIVEN THE RIGHT TO KNOW WHO TOUCHED HER INAPPROPRIATELY? If this was your wife, I'm sure you would have already been to the bottom of it and would have proceeded with firing whoever it was, not to mention, made their life a not so nice place to be.

I do not know Darla nor Lester. I do know that people have been saying that Lester is not a good person and that leaves Darla not being a good one either. So does that give the police a right to touch her or anyone else inappropriately? If the other police officer has NOTHING TO HIDE then there should not be a problem with proceeding and allowing Darla to confront the person who did this to her.

That is something that the people not only in this county, but everywhere need to learn. Just because someone may have a bad name, sure doesn't mean that they should be ignored when something like this has went on. This woman went to the public with her complaint and had she been lying, I doubt she would have been trying to get to the bottom of it in the fashion she did. She should have been taken seriously.

Mr. Jonese, do not sit back and pretend like you have not known yourself for years, and prior to your position as sheriff, that you never heard or knew that the officers under your command have a horrible reputation in regards to their sexual and deviant behaviors. Do not try to hide from the situation any longer, because when it comes time for another election and for you to be voted on, we will once again make the move to replace you with yet another person. If that person does the same, they will also be voted against until we find a sheriff who will take complaints serious no matter who they are.

I do think you have a child and if it is a girl, do you want the police officers to get by with what they are and do something to your daughter one day when she gets older? (Again that is if you even have a daughter, because I do not know.) If not, then the bull needs to stop now. Mr. Jonese, put a stop to the stuff your employees are doing so that later on, it will not be continued. I for one would be scared to death for my daughters to go to your police officers for help. You did not give them the reputation they have, THEY did it themselves, but Mr. Jonese, it is going to take YOU to put a stop to them!

Get Darla the name of the police officer so she can do what needs to be done. Allow it to go to court and allow the courts to decide what the truth is. You are not the judge nor the jury. Do the right thing.
