Community Alert--Edray Residents--Walt Helmick Detention Center for the Criminally Insane Running

Editor's Note: We were the first to alert the county to the pending presence of the detention center for the criminally insane which was snuck in under the radar. It is up and fully functioning. I even saw an inmate the other day strolling outside the facility.

There are no bars and it appears that the center operates on the honor system. Inmates occasionally visit in the community. There are no bars, not even a fence.

The inmates are supposed to be old and decrepit incapable of harm to the community. But we never know when someone who is not "old and decrepit" is being housed there. It is an ultra secret facility for people who have committed heinous crimes but are unable to be tried for their crimes due to mental illness. These are not your typical ax murders, serial killers, or even child rapists like Roman Polanski. They are individuals that the courts cannot try because they are so far gone mentally as to be considered incapable of knowing right and wrong. The are considered not guilty by virtue of their insanity.

There were no public hearings on this center. The public had no input. Even Seneca Mental Health refused to participate in the program. In addition to this, the center was located right in the heart of the Edray community surrounded by homes and families.

The Insanity Defense and Diminished Capacity

Mental illness in a criminal defendant at the time of an alleged offense can give rise to three types of mental-state defenses: insanity and two distinct variants of diminished capacity. Each of these defenses addresses the issue of criminal responsibility differently, and each has met with varying degrees of acceptance in the criminal justice system.

For all its controversy, or perhaps because of it, the insanity defense is widely considered the classical realm of forensic psychiatric input. It excuses a criminal defendant for his conduct because of his mental disease or defect. This is true whichever of the following three standards is used:

1. M'Naghten rule: Excuses a defendant who, by virtue of a defect of reason or disease of the mind, does not know the nature and quality of the act, or, if he does, does not know that the act is wrong. [57]

2. Durham rule: Excuses a defendant whose conduct is the product of mental disease or defect. [30]

3. ALI test: Excuses a defendant who, because of a mental disease or defect, lacks substantial capacity to appreciate the criminality (wrongfulness) of his conduct or to conform his conduct to the requirements of law. [67]

Editor's Note: Here is a simple explanation: Kill enough people, kill them in a bizaare fashion, or pick the wrong person to kill. It will help gain admittance if you eat your victim or try to assassinate the president. Rec Viewing: "Silence of the Lambs". That could qualify you for the Edray Facility.

What is the only difference between Norman and the residents of the Edray facility? Norman is insane, just not convicted - for the moment.

Now if we had zoning there would at least had to have a hearing about land use change. But anything goes in Pocahontas County, just like Norman likes it.

We already had laws that required a hearing. They just ignored them!
