Message:   Thanks to everyone for their answers. It seems I was not the only one to be a little confused by rule 3b. I may have asked my question a bit too soon. I thought my opponents 40 days would have been exceeded by now, but after carefully looking at a calendar and taking into account both leaves and the time delta between server time and local time it seems my opponent still has ~24 hours left to make his move.
