I think I had that case.

- tournament started in 2006
- opponent didn't move for more than 40 days in 2007

- I claimed the win
- TD asked opponent for comment
- after considering his reply insufficent the TD granted me the win

- opponent appealed
- AC refused the appeal

I don't want to give the specific details of my case, but the following general statement is clarifing, I think.

From the decision of the AC written by its Chairman Ragnar Wikman on 14 03 07:

>>Once again I have to refer to the fact that 3b of the WEBSERVER rules - for tournaments STARTED BEFORE 01.01.2007 - is much stricter than the email rules.
If more than 40 days has been used and the TD not adequately informed about - AND AGREED TO! - further delays, the game WILL be scored as lost.<<
