I never said that rules can be changed after the event has started, I was only giving practical advice: if your opponent does not move for 40 days AND you did not receive a notification, then you can safely claim a win; and forget about rule modifications. This doesn't mean your claim will be granted but as a player that's what you need to do.

If there was a notification sent by the opponent, then the new rule applies only to events started after January 2006 even though it became effective on January 2007. This is what Gerhard Radosztics told me 2 months ago.
